| 释义 | 涉及／牽涉 An expression used in relation to covenants affecting land, including covenants in leases. A covenant touches and concerns the land if it affects the way the land may be occupied, or benefits or improves the value of land. The words ‘has reference to the subject matter of the lease’ are the modern phraseology used by statute (Conveyancing and Property Ordinance (Cap 219) ss 31–32) in place of the traditional phrase ‘touch and concern the land’ (Spencer’s Case (1583) 5 Co Rep 16a). The two expressions have the same meaning and effect: Davis v Town Properties Investment Corp Ltd [1903] 1 Ch 797 (CA). The concept is relevant in determining which covenants bind successors in title to the original covenantor and covenantee.
