释义	公約裁決 An award made in a state or territory, other than Hong Kong, which is a party to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958. Hong Kong is a party to the New York Convention by virtue of its status as a Colony of the United Kingdom and is therefore not listed as a party in its own right. The New York Convention has been given effect under the Arbitration Ordinance which provides that a Convention award is enforceable in Hong Kong either by action or in the same manner as the award of an arbitrator is enforced: Arbitration Ordinance (Cap 341) s 42. A Convention award is made pursuant to an ‘agreement in writing’, which is defined by the New York Convention as including an arbitral clause in a contract or an arbitral agreement, signed by the parties or contained in an exchange of letters or telegrams, to submit present or future differences to arbitration: sch 3 art II(1), (2). Where an award has been made in the PRC before 1 July 1997, the relevant time for deciding whether it is a Convention award is when a party is seeking to enforce it: Hebei Import and Export Corp v Polytek Engineering Co Ltd (No 2) [1998] 1 HKC 192; [1998] 1 HKLRD 284.
