释义 | 固有地危險 In occupier’s liability, an activity which, without more, is considered to pose a certain level of risk to the person performing it. An occupier will be liable in negligence to anyone who suffers injury on the occupier’s property as a result of carrying on an activity regarded as inherently dangerous. This is because an occupier is considered to be able to foresee the risks of any activity regarded by the law as inherently dangerous, and to take appropriate precautions to prevent that danger materialising: Bank of East Asia Ltd v Tsien Wui Marble Factory Ltd & Ors [2000] 1 HKC 1 (CFA); Hsu Li Yun v Incorporated Owners of Yuen Fat Building [2000] 2 HKC 365 (CA). However, the occupier may expect that a person, in the exercise of his calling, will appreciate and guard against any special risks ordinarily incident to it, so far as the occupier leaves him free to do so: Occupiers Liability Ordinance (Cap 314) s 3(3)(b). An occupier may rely on this section only if the visitor is actually free to guard against the risks inherent to the exercise of his calling: Ma Hui Ting Kuk & Anor v Cheong Hing Ha Kee Constructions Co Ltd & Anor [1992] 2 HKC 391 (HC).
