释义 | 普通襲擊 An assault which does not result in any actual physical injury to the person assaulted. Assault means an act by which a person intentionally or recklessly applies unlawful force to the complainant: R v Williams [1984] 78 Cr App Rep 276; A-G v Chan Yuen Lung & Ors [1989] 1 HKC 470. It can include both a threat of physical harm or an actual touching of the person assaulted. Mere words will not suffice to constitute an assault: R v Tsang Cheong Fuk [1950] HKLR 276; R v Lam Leung Ping (CACC 579/77, unreported). A complaint of pain was held to be a common assault but not the actual bodily harm: R v Chan Wai Hung [1986] HKC 26. Common assault is unlawful under the Offences Against the Person Ordinance (Cap 212) s 40. In Hong Kong, the court has held that common assault is primarily a common law misdemeanour and s 40 provides for the mode of punishment: Ng Chun Hai v Dopehie [1961] HKLR 727. The offence of common assault was held to be an indictable offence: Magistrates Ordinance s 2; R v Wong Chi Man [1990] 1 HKC 196. A common assault is an alternative verdict on a charge of robbery, assault with intent to rob and blackmail: Theft Ordinance (Cap 210) s 32, sch.
