释义	延期費利率 The rate used to calculate the liquidated damages suffered by a shipowner for the time taken to load or discharge cargo in excess of the time allowed (laytime) in a voyage charterparty. It is an estimate of the operational costs of the ship, and the profit the ship would be able to earn, had the ship been released as originally scheduled. In the event the rate is fixed at daily rate only, the shipowner is, prima facie, entitled to demurrage for a whole day, when any time of the day is used: Commercial Steamship Co v Boulton (1875) LR 10 QB 346; South Australian Voluntary Wheat Pool v Owners of the Riol (1926) 24 Ll L Rep 363. The rate is thus usually fixed at daily rate and pro rata for part of a day: Dias Compania Naviera SA v. Louis Dreyfus Corporation [1978] 1 All ER 724, 1 WLR 261; GENCON (1994) cl 7. The problem can also be avoided by fixing the demurrage rate at hourly basis. In tanker voyage charterparties, the demurrage rate may be stated by reference to the standard demurrage rate provided in the Worldwide Tanker Nominal Freight Scale (Worldscale), which is jointly published by Worldscale Association (London) Ltd and Worldscale Association (NYC) Inc. An example can be found in Shellvoy 5 (1987) cl 15.
