释义 | 非自願行為 In tort law, an act performed without any deliberate intent, which would constitute an intentional tort if it was occasioned with intent. Liability is avoided because the person performing the involuntary act is not considered to be responsible for it: National Coal Board v J E Evans & Co (Cardiff) Ltd & Anor [1951] 2 All ER 310, 2 KB 861 (CA). An example is being thrown onto another’s land: Smith v Stone (1647) Sty 65. If the defendant’s conduct is largely affected by his insanity, involuntary and purely automatic, he is not liable in tort: Morriss v Marsden & Anor [1952] 1 All ER 925.
