The thing of which a person is alleged to have notice must be brought clearly to that person’s attention: Goodyear Tyre and Rubber Co (Great Britain) Ltd v Lancashire Batteries Ltd [1958] 1 WLR 857. Notice may be actual or constructive, or may be imputed.
