Opinion or information given by one banker to another as to the respectability and financial standing of a customer. The giving of information about their customers by one banker to other bankers is a well-established custom among bankers: Parsons v Barclay & Co & Anor (1910) 26 TLR 628; Swift v Jewsbury (1874) LR 9 QB 301. A bank may be held liable if the opinion was given negligently. In such a case it must be shown that the banker is under a duty of care in a situation where it is plain that the party seeking information or advice trusted the party supplying it to exercise such a degree of care as the situation required; and it is reasonable so to trust the person supplying the information; and the latter knew or ought to have known that the enquirer is relying on him: Hedley Byrne & Co Ltd v Heller & Partners Ltd [1964] AC 465. However, the banker’s liability can be avoided by a suitable disclaimer clause such as the one in the Hedley Byrne case. See also Credit rating; Implied consent; Liability.
