| 释义 | 褻瀆神明 Irreverent talk or treatment of a religious or sacred thing. Blasphemy is an offence: Magistrates Ordinance (Cap 227) sch 2. It is a common law offence to publish blasphemous matters. The actus reus of the offence of blasphemy consists of the publication of words spoken or written. For the purpose of establishing mens rea, it is sufficient for the prosecution to prove an intention to publish material which is in fact blasphemous, and it is not necessary to prove further that the defendant intended to blaspheme. It is not blasphemous to speak or publish opinions hostile to the Christian religion, or to deny the existence of God, if the publication is couched in decent and temperate language. The test to be applied is as to the manner in which the doctrines are advocated and not as to the substance of the doctrines themselves: R v Lemon, R v Gay News Ltd [1979] AC 617, [1979] 1 All ER 898, [1979] 2 WLR 281 (HL).
