An essential criterion in establishing liability in negligence. A duty of care is owed on the basis that if care is not taken, there is a reasonably foreseeable risk of injury to another person. Where the harm caused to the plaintiff in a negligent suit is reasonably foreseeable, a prima facie case is established: Ross v Caunters (A Firm) [1980] Ch 297; Born Chief Co (t/a Beijing Restaurant) v Tsai George & Anor [1996] 2 HKC 282 (CA). Foreseeability is also relevant in assessing the extent of damage or injury for which a defendant may be liable: Overseas Tankship (UK) Ltd v Morts Dock & Engineering Co Ltd (The Wagon Mound - No 1) [1961] AC 388.
