释义 | 並無律師代表的訴訟人 Where a party to proceedings acts or appears for themselves, unrepresented by a legal practitioner. A judge or magistrate has a duty towards an unrepresented defendant to ensure the defendant has a fair trial and to give such assistance as is necessary for the proper conduct of his defence: R v Tam Kin Wing [1997] 3 HKC 285, 1 HKLRD 333 (HC). The judge or magistrate has no duty to conduct the defence as such or take over the cross-examination for the accused: R v Tse Kwok Fu [1992] 1 HKC 142 (CA).
