| 释义 | 簡易判決 Discretionary judgment or verdict given in favour of the plaintiff where there is evidence of the fact upon which the claim is based and the defendant can offer no defence: The Rules of the High Court (Cap 4A) O 14 r 1(1). However, the rule does not apply where the plaintiff’s claim is for libel, slander, malicious prosecution, false imprisonment or seduction or is based on an allegation of fraud or where it is an Admiralty action in rem: O 14 r 1(2). Summary judgment may be given in favour of the defendant where the plaintiff has no defence to a claim made in the counterclaim: O 14 r 5. Where the plaintiff’s cause of action is for specific performance of an agreement (whether in writing or not) for the sale, purchase, exchange, mortgage or charge of any property, or for the grant or assignment of a lease of any property, with or without an alternative claim for damages; or for rescission of such an agreement; or for the forfeiture or return of any deposit made under such an agreement, and the defendant has no defence to the action, the plaintiff may apply for summary judgment against the defendant: O 86 r 1. A person may apply for summary judgment for the possession of land which is occupied solely by a person or persons (not being a tenant or tenants holding over after the termination of the tenancy) who entered into or remained in occupation without his licence or consent or that of any predecessor in title of his: O 113 r 1. Also known as ‘summary relief’ or ‘summary disposal’. 如有關申索所依據的事實有證據是被告人無法提出抗辯，則可作出對原告人有利的酌情性判決或裁決：《高等法院規則》（第4A章）第14號命令第1(1)條規則。但如原告人的申索就永久形式誹謗、短暫形式誹謗、惡意檢控、非法禁錮或誘姦；或基於詐騙指稱而提出訴訟；或屬海事對物訴訟，則此原則不適用：第14號命令第1(2)條規則。如原告人對有關的反申索書中提出的申索無法抗辯，則可作出對被告人有利的簡易判決：第14號命令第5條規則。 如原告人的訴訟因由是要求強制履行就任何物業的售賣、購買、交換、按揭或押記或就任何物業的租契的批出或轉讓而訂立的協議（不論是否為書面），不論是否有要求損害賠償的交替申索，或要求撤銷該協議的申索，或要求沒收或退回已根據該協議支付的訂金，原告人可以被告人對該訴訟無可抗辯為理由而向法庭申請作出針對被告人的簡易判決：第86號命令第1條規則。凡申索收回土地的管有的人，如指稱土地純粹由一人或多於一人（非在租賃終止後仍繼續佔用的租客）未經他或任何在他之前的業權持有人的特許或同意而進入或繼續佔用土地，則一人可向法院申請管有土地的簡易判決：第113號命令第1條規則。另稱「簡易濟助」或「簡易處置」。 |
