A person who habitually uses intoxicating liquor to such an extent that he or she loses the power of self-control with respect to the use of intoxicating liquor, or as to endanger health, safety, or welfare of himself or herself or other persons. Extreme intoxication may deprive a person of his or her reason and render the contract made with such a person void (Pitt v Smith (1811) 3 Camp 33), but the court would usually hold the contract to be voidable (Say v Barwick (1812) 1 Ves & B 195).
