| 释义 | 政府租契 A lease of land granted by or on behalf of the Government, which includes (a) an instrument whereby (i) the term of the lease has been extended; or (ii) the provisions of the lease have been varied; (b) an agreement for such a lease; and (c) a Crown lease: Interpretation and General Clauses Ordinance (Cap 1) s 3. It was known as ‘Crown lease’ before 1 July 1997. The Government Leases Ordinance (Cap 40) applies (a) in the case of Government leases which expired before the commencement of the Ordinance (i) to every such Government lease under which land in New Kowloon or in any other part of the New Territories was demised for a term of 75 years and which contained a right of renewal for a further term; and (ii) to the Government lease of each lot specified; and (b) in the case of Government leases which expire after the commencement of the Ordinance (i) to every such Government lease under which land in Hong Kong (other than the New Territories) is demised for a term of 99 or 75 years and which contains a right of renewal for a further term; and (ii) to every such Government lease under which land in New Kowloon or in any other part of the New Territories is demised for a term of 21 years and which contains a right of renewal for a further term: Government Leases Ordinance (Cap 40) s 3(1). However, the Government Leases Ordinance does not apply to any lease to which the New Territories (Renewable Government Leases) Ordinance (Cap 152) applies: s 3(2). The Government of the Hong Kong SAR shall be responsible for the management, use and development of land and for the lease or grant for use or development: Basic Law art 7.
