释义 | 絕育 The medical procedure by which a person is rendered unable to reproduce. A victim may claim damages for an unwanted birth after unsuccessful sterilisation: Walkin v South Manchester Health Authority [1995] 4 All ER 132, 1 WLR 1543 (CA). The court may exercise its wardship jurisdiction where the sterilisation of children is concerned: Re B (a minor) (Wardship: Sterilisation) [1988] AC 199, [1987] 2 All ER 206 (HL); Re D (a minor) [1976] 1 All ER 326, [1976] Fam 185. It is not unreasonable to refuse an abortion when sterilization fails: Emeh v Kensington and Chelsea and Westminster Area Health Authority [1985] QB 1012, [1984] 3 All ER 1044 (CA); Ho Yee Sup v Chan Yuk May (HCA 3490/86, unreported). Family planning policies need to be compatible with the right to found a family and thus programmes of non-voluntary sterilisation will be unacceptable: Halsbury’s Laws of Hong Kong, Vol 14, Human Rights [210.221].
