An infringement or violation of rights of another person without lawful authority or which is not permitted by the statutes and common law of Hong Kong; any universal or international concept of unlawfulness. Lawful authority can take the form of consent, statutory authority, or a contractual right or licence. Where the unlawful interference is caused by a direct and intentional or negligent act of a defendant, the plaintiff may have an action against the defendant for trespass to the person, goods or land. The question whether any particular interruption amounts to an unlawful interference depends upon the general circumstances of the case: Saint v Jenner [1973] Ch 275, 1 All ER 127 (CA). No one shall be subjected to arbitrary or unlawful interference with his privacy, family, home or correspondence: Hong Kong Bill of Rights Ordinance (Cap 383) s 8 art 14(1). Everyone has the right to the protection of the law against such interference: s 8 art 14(2). The term ‘unlawful’ means that no interference can take place except in cases envisaged by the law. Interference authorised by states can only take place on the basis of law, which itself must comply with the provisions, aims and objectives of the International Covenant on Civil and Political Rights (ICCPR).
