| 释义 | 公訴書 A written accusation detailing a charge of a specific crime that is to be tried by a court: R v Slator (1881) 8 QBD 267 (DC). A bill of indictment should be framed such that all parties, particularly the accused, know the nature of the charge being brought and know what it is the accused may be convicted of: Indictment Rules (Cap 221C) r 3(1); R v Chau Chun Wai (CACC 167/89, unreported); R v Woods [1968] 3 All ER 709, 53 Cr App Rep 30, [1969] 1 QB 447 (CA). It includes any criminal information triable by a jury: Criminal Procedure Ordinance (Cap 221) s 2. The form of indictment: Criminal Procedural Ordinance (Cap 221) sch 1. Every indictment shall be signed by the Secretary for Justice and thereafter be brought to the Registrar’s office and shall be filed by him in the court: Criminal Procedure Ordinance (Cap 221) ss 17, 26.
