释义 | 明知而參與 To participate in an activity. Any person who is knowingly concerned in, or in the taking of steps with a view to, the fraudulent evasion of the payment of a levy, whether due from that person or from any other person, will be guilty of an offence: Industrial Training (Clothing Industry) Ordinance (Cap 318) s 33(1); Pneumoconiosis (Compensation) Ordinance (Cap 360) s 39. To be knowingly concerned in an offence requires proof of some form of mens rea: Sweet v Parsley [1969] 1 All ER 347, 53 Cr App Rep 221, [1970] AC 132, (HL). In determining whether the requisite knowledge has been proved, account may be taken of the means of knowledge of the accused and, in some cases, whether the accused has wilfully shut his or her eyes to the truth: Westminster City Council v Croyalgrange Ltd & Anor [1986] 2 All ER 353, 1 WLR 674 (HL).
