Payment under a mistake of law cannot in general be recovered, although there may be rights in equity to follow money paid by mistake, particularly out of a deceased’s estate: Ministry of Health v Simpson [1951] AC 251, [1950] 2 All ER 1137 (HL); Bank of East Asia v Rogerio Sou Fung Lam (t/a R Lam & Co (a firm) [1987] 1 HKLR 181 (CA). However, payment made under a mistake of fact is prima facie recoverable, provided the payer can show there was no intention to transfer the money to the payee in any event, that there was no consideration for the payment, and that the payee had not in good faith changed position: Barclays Bank Ltd v W J Simms Son & Cooke (Southern) Ltd [1980] QB 677, [1979] 3 All ER 522; R E Jones Ltd v Waring and Gillow Ltd [1926] AC 670 (HL).
