释义 | 迫遷/驅離 Lat - out and conquer. The process of removing a person from occupation of premises, including legal proceedings and physical removal. In many commercial tenancies, a lessor may evict the lessee simply by re-entering the premises and physically ejecting the lessee. However, in residential tenancies, an eviction generally may not be effected without a court or tribunal order: for example, Landlord and Tenant (Consolidation) Ordinance (Cap 7) s 53(2)(e); Fok Ming Hung v Chan Hing Hong [1981] HKC 514. In certain circumstances, a lessee evicted from premises may apply for relief against forfeiture.
