Implied authority arises where agents who practise a particular trade, business or profession are normally authorised to do everything which is usually or ordinarily done in such a trade, business or profession: Wong Wai Hing & Anor v Hui Wei Lee [2001] 2 HKC 19 (CA); Daewood Hong Kong Ltd v Mana Maritime Inc & Ors [1997] 3 HKC 109 (CFI). Implied authority is an extension of an express authority to give it business efficacy: Man Kou Tan v Timewin Development Ltd [1987] 3 HKC 504. The extent of that authority is determined by the position of the agent in the principal’s organisation and by the organisation’s location: Ching Mei Bo v Lai Yuen Wah & Ors [1959] HKDCLR 186.
