| 释义 | 隱含特許 Legal permission or consent for conduct or use of property found to exist based on the conduct or acts rather than on express grant or agreement. See also Exclusive licence; Licence. Intellectual property - Permission not expressly granted but which is found to exist from the terms of an agreement; from the nature of the item containing the copyright material; from the conduct of the person or body granting the permission; or from trade practice and custom. Anybody acquiring a patented article had an implied licence to keep it in repair but the implied licence does not extended to renewal: Canon Kabushiki Kaisha v Green Cartridge Co (HK) Ltd & Anor [1995] 1 HKC 729 (HC). That person is also impliedly licensed to infringe the seller's copyright in his drawings to the extent necessary to enable such repairs to be carried out. See also Copyright. Tort - Permission or consent deemed by the law to have been given by a person to acts which would otherwise constitute an interference with the person’s rights: HKSAR v Chau Fung [1999] 4 HKC 652 (CFI); Common luck Investment Ltd v Cheung Kam Chuen [1999] 2 HKC 719 (CFA). Where a landlord has covenanted to do repairs a licence to enter to do the repairs is implied: Edmonton Corp v W M Knowles & Son Ltd (1961) 60 LGR 124.
