| 释义 | 外地婚姻 A marriage celebrated outside the Hong Kong SAR. To determine the validity of marriages contracted overseas, three matters essentially will be considered by the courts. First, the marriage must have been celebrated in conformity with the formal requirements of the law of the place where the marriage was celebrated (lex loci celebrationis), ie the formal validity of a marriage: Chung Kai Fun v Lau Wai King [1966] HKLR 881. Second, both parties must have possessed the capacity to marry in accordance with the law of each party’s antenuptial domicile, ie the essential validity of a marriage: Ong Constantino Erminda v Chau Shui Hing (No 1) [1989] 1 HKC 237. Third, a foreign marriage will not be recognised by the courts if it is repugnant to the conscience of the courts: Cheni v Cheni [1965] P 85; Wong Zhong Lan-Xiang & Ors v Frank Wong & Anor [2003] 4 HKC 609. The rules of private international law govern the questions as to the formal or essential validity of a marriage. The celebration of a marriage outside Hong Kong and its validity under the law of the country where it was celebrated may, in any matrimonial proceedings in which the existence and validity of the marriage is not disputed, be proved by the evidence of one of the parties to the marriage and the production of a document purporting to be a marriage certificate or similar document issued under the law in force in that country, or a certified copy of an entry in a register of marriages kept under the law in force in that country: Matrimonial Causes Rules (Cap 179A) r 40(1). Expert evidence to establish that a particular ceremony constituted a valid marriage may be needed.
