| 释义 | 法律責任的準則／標準 Either civil or criminal liability, depending on whether it is enforced by civil or criminal courts. The standard of liability is civil in tort or negligence. Liability may also be strict, for example in the case of certain statutory offences, in which it is not necessary for the prosecutor to prove that the defendant committed the act or omission constituting the offence intentionally, knowingly or recklessly, or that the defendant had knowledge of any specific ingredient of the offence: for example Occupational Safety and Health Ordinance (Cap 509) s 3(1). The standard of civil liability in carriage by road is of reasonable care, not that of warranty: John Carter (Fine Worsteds), Ltd v Hanson Haulage (Leeds), Ltd. [1965] 2 QB 495, 1 All ER 113, [1965] 2 WLR 553 (CA).
