释义 | 推定條件 A condition that the court deems or construes into an instrument or transaction in order to give effect to any obligations or rights arising out of the disposition of the property. A constructive condition may be distinguished from a constructive trust in which the former creates only a personal obligation to fulfil the condition in order to take possession absolutely, whereas the latter is annexed to the property and the third party may exercise any rights against the property itself. A true constructive condition will prevent the vesting of property in the transferee unless and until he or she fulfils it. However, where the condition involves the payment of money to a third party, the court is more likely to find a trust or an equitable charge.
