| 释义 | 權限範圍 In agency law, the extent of the nature and type of acts an agent is authorised to do on the principal’s behalf that affect the legal liability of the principal. Generally, the principal cannot escape liability for acts done by the agent within the scope of actual or apparent authority, in the absence of notice of any particular instructions to the agent limiting the authority. Where the agent’s act is not within the scope of his or her express or implied authority, and falls outside the apparent scope of the authority, the principal is not bound. It is often difficult to ascertain the exact scope of an agent’s authority: Wong Wai Hing & Anor v Hui Wei Lee [2001] 1 HKLRD 736; Tullett & Tokyo International Securities Ltd v APC Securities Co Ltd [2001] 2 HKLRD 356. The scope of the agent’s authority is a question of fact and may be determined by the surrounding circumstances: Australia and New Zealand Bank Ltd v Ateliers de Constructions Electriques de Charleroi [1967] 1 AC 86 (PC).
