释义 | 私隱權 The right of individuals to determine for themselves when, how and to what extent information about them is communicated to others. It includes the right to be free from arbitrary entries, searches and seizures, the right to private life, the right to private communication, the right not to have personal information published (for example, the Personal Data (Privacy) Ordinance (Cap 486) which protects the privacy of individuals in relation to personal data), and the right to have access to personal information. The right to privacy is primarily protected by the Basic Law arts 28-30, the Hong Kong Bill of Rights Ordinance (Cap 383) s 8 art 14, and the International Covenant on Civil and Political Rights 1966 art 17. 個人為自己決定何時,如何及以甚麼程度與他人傳達訊息的權利。私隱權包括免於無理進入,搜查及扣留的權利;私人生活的權利;私人通訊的權利;個人資料不被公布的權利(例如《個人資料(私隱)條例》(第486章)保障個人資料的私隱權),及有取得個人資料的權利。私隱權基本上由下列的法律文件保障:《基本法》第28至30條,《香港人權法案條例》(第383章)第8條第十四條,及《1966年公民權利和政治權利國際公約第17條。 |
