Generally, something that happens without intention or design.
Carriers - The expression ‘accident’ is used in the popular and ordinary sense of the word denoting an unlooked-for mishap or an untoward event which is not expected or designed: Yip Ho v Hong Kong & Kowloon Wharf & Godown Co Ltd [1969] DCLR 1. An act of God is an accident due to natural causes directly and exclusively without human intervention: The Star Ferry Co Ltd v The Owners of the Ship or Vessel ‘Argonaut’ (Greek Flag) & Anor [1980] HKLR 921 (HC). Civil Aviation - Where an accident to aircraft occurs, investigation may be carried out to determine the circumstances and causes of the accident with a view to the preservation of life and the avoidance of accidents in the future: Hong Kong Civil Aviation (Investigation of Accidents) Regulations (Cap 448B).
Coroners - Where a person dies by accident and whether or not the death of the person is a reportable death, a coroner may, if he considers that an inquest is necessary, hold an inquest into the death with or without a view of the body as he thinks fit: Coroners Ordinance (Cap 504) s 14(1)(a). A coroner may also hold inquests in respect of deaths arising out of certain civil aviation accidents: Coroners Ordinance (Cap 504) s 18. See also Civil Aviation.
Criminal law - An event for which an accused is not criminally responsible because it was neither intended nor foreseen by the accused and was one that no ordinary person would have expected to happen as a result of the accused’s conduct: Vallance v R (1961) 108 CLR 56. The result of an involuntary reflex action might be an accident: Ryan v R (1967) 121 CLR 205. A person is not criminally responsible for the accidental death of another: R v Van Den Bemd (1994) 179 CLR 137.
Negligence - An unexpected event which if it occurs as a result of a person’s negligence and injures another as a result, entitles the injured party to recover damages under the law of tort. If no negligence is involved, the injured party may seek compensation under a non-fault compensation scheme, for example, under the Employees Compensation Ordinance (Cap 282). 死因裁判官 - 凡任何人因意外而死亡,則不論該宗死亡個案是否須予報告的死亡個案,如死因裁判官認為有需要進行研訊,即可就該宗死亡個案進行研訊,並由他決定是否檢視屍體:《死因裁判官條例》(第504章)第14(1)(a)條。死因裁判官也可就某些民航意外引致的死亡進行研訊:《死因裁判官條例》(第504章)第18條。另見 Civil aviation。
