| 释义 | 產品的保證條款／保證書 A standard form document, produced and issued by the manufacturer or supplier of a product, which sets out the rights and obligations of the manufacturer, the supplier, and the acquirer in relation to the product. It is an agreement with reference to goods which are the subject of a contract of sale but collateral to the main purpose of such a contract, the breach of which gives rise to a claim for damages but not to a right to reject the goods and treat the contract as repudiated: Sale of Goods Ordinance (Cap 26) s 2(1). For example, it is an undertaking in writing, in whatever form, that a statement with respect to the quantity of pre-packed goods which is contained in any invoice or similar document relating to the goods, or marked on the container of such goods, is accurate: Weights and Measures Ordinance (Cap 68) s 20(6). A warranty may be given in consideration of an agreement to enter into a contract of sale of the goods to which the warranty relates with a party other than the person giving the warranty: Wells (Merstham) Ltd v Buckland Sand and Silica Co Ltd [1965] 2 QB 170, [1964] 1 All ER 41.
