A written accusation of one or more persons of a crime following committal for trial by a magistrate or one of the other means by which an indictment may be preferred: R v Slator (1881-82) 8 QBD 267 (DC); Criminal Procedure Ordinance (Cap 221) s 24A. It includes any criminal information triable by a jury: Criminal Procedure Ordinance (Cap 221) s 2. The indictment should be in the specified form: Indictment Rules (Cap 221C) Sch. There are four major parts of an indictment: the commencement; the statement of the offence; the particulars of offence; signature: Halsbury’s Laws of Hong Kong, Vol 9, Criminal Law and Procedure [130.678]. The purpose of an indictment is to state the allegation against the accused in plain language so that he knows what he is charged with and what he may be convicted of: The Queen v Chau Chun Wai (CACC 167/89, unreported).
