释义 | 對司法權的抗辯 A special plea entered by an accused person to the effect that the court has no jurisdiction to try the offence contained in the indictment, presentment, or information: R v Jameson [1896] 2 QB 425. It is open to a person extradited or surrendered to Hong Kong pursuant to international arrangements. There is a difference between a plea to the jurisdiction of the court to hear and determine the charge and a plea of not guilty on the basis that the facts did not occur within the jurisdiction of the court. See also Special plea. 由被告人作出的特別抗辯﹐致使法庭沒有司法權受理包含在起訴書、陳述書或資料的罪行:R v Jameson [1896] 2 QB 425。根據國際協議﹐被引渡或交還到香港的人可使用對司法權的抗辯。對法庭聆訴及裁定檢控的司法權抗辯有別於基於事實並不在法庭司法權之內發生而無罪的抗辯。另見 Special plea。 |
