| 释义 | 法院 A place where justice is administered. The three-tier levels of courts in Hong Kong are: High Court (a superior court of record and of unlimited civil jurisdiction) comprises the Court of Final Appeal, Court of Appeal and Court of First Instance; District Court (an inferior court of record); Magistracy Court. Tribunals are set up with less formal procedures and they sometimes have overlapping jurisdiction with the District Court such as the Small Claims Tribunal. Courts are given a wider meaning to include the Chief Justice and any other judge, officer of any court, commissioner, arbitrator, or other person having, by law or by consent of parties, authority to hear, receive, and examine evidence with respect to or concerning any action, suit, or other proceeding civil or criminal, or with respect to any matter submitted to arbitration or ordered to be inquired into or investigated under any commission: Evidence Ordinance (Cap 8) s 2. There was no rigid rule whereby the word ‘court’ must be construed as excluding jurisdiction exercised in chambers. In relation to the right to appeal, it is not restricted to the Full Court of the High Court acting in its appellate capacity: A-G v Chiu Pak Yue and Anor [1960] HKLR 330. Regard must be had to the context and to the ordinary practice which the legislature must be assumed to know: Friend v Wallman [1946] 2 All ER 237.
