| 释义 | 監護人 1. In relation to a minor, a person who is legally entitled to parental rights and duties in relation to a minor: Halsbury’s Laws of Hong Kong, Vol 12, Family Law [180.316]. Generally, a guardian has all the rights, powers and duties of a guardian of the minor’s estate, including in particular the right to receive and recover in his own name for the benefit of the minor property which the minor is entitled to recover: Guardianship of Minors Ordinance (Cap 13) s 18. 2. In relation to a mentally incapacitated person, a person having charge of a mentally incapacitated person who is under the age of 16, or the Director of Social Welfare; a person having charge of a mentally incapacitated person who is under the age of 18; the Director of Social Welfare or such person specified in the guardianship order under pt IIIA of Mental Health Ordinance (Cap 136); person appointed under pt IVB of the Mental Health Ordinance (Cap 136) in respect of a mentally incapacitated person who has attained the age of 18: Mental Health Ordinance (Cap 136) s 2.
