释义 | 契諾利益 1. The advantage enjoyed under a covenant. 2. In relation to land, the advantage or enhancement of value enjoyed by land as a result of a covenant affecting other land. Subject to exceptions in relation to positive covenants, the benefit of a covenant would generally be enforceable by successors in title of the covenantee if the covenant ‘relates to’ (touched and concerned) the land; or is expressed and intended to benefit the land of the covenantee and his successors in title or persons deriving title to that land under or through him or them: Conveyancing and Property Ordinance (Cap 219) s 41. An example in relation to the latter is where a seller sells a flat in a multi-storey building and provides in the assignment that the flat is assigned with the benefit of the deed of mutual covenant.
