释义 | 合併之謬誤 The mistaken view that the rules of common law and equity have been amalgamated, rather than merely that their administration was amalgamated, following the (UK) Judicature Act 1873. Under this view equity has lost its identity as an independent body of legal principle, and a new body containing both equity and common law has been created. In reality, the priority given to equity over the common law in the event of conflict merely reflects the control which the Court of Chancery and its modern equivalents have always exercised over courts of law. The process of fusion involved the administration of law and equity but did not effect a merger of the two bodies of principle: Salt v Cooper (1880) 16 Ch D 544, 50 LJ Ch 529 (CA). The fusion fallacy has given rise to arguments, for example that defences available to a cause of action at common law are available to an equitable action.
