释义 | 最佳證據原則 An old rule which insisted on the leading of the ‘best evidence’ that the nature of the case would permit. Strict interpretation of this principle has long been obsolete and the rule is now only of importance in regard to the primary evidence of private documents: Queen Caroline’s Case (1820) 2 Brod & B 284, 129 ER 976; MacDonnell v Evans (1852), 11 CB 930, 138 ER 742; R v Leung Ping (CACC 339/97, unreported); Garton v Hunter (VO) [1969] 1 All ER 451, 2 QB 37 (CA). Hence secondary evidence of a private document is inadmissible if primary evidence is available. Before secondary evidence is tendered, it is necessary to account for the absence of the original: Jones v Tarleton (1842) 9 M & W 675; R v Francis (1874) LR 2 CCR 128. The best evidence rule does not apply to copy tapes which means that evidence derived from tape recordings that are mechanically or electronically copied from an original recording will be admissible: Kajala v Noble (1982) 75 Cr App R 149; Butera v DPP (1987) 164 CLR 180; Taylor v Chief Constable of Cheshire [1986] 1 WLR 1479, [1987] 1 All ER 225.
