释义 | 法律專業特權 A common law principle which provides that confidential communications between legal practitioner and client for the sole purpose of the client obtaining, or the legal practitioner giving, legal advice or for use in existing or contemplated litigation need not be given in evidence nor disclosed by client or by the legal practitioner, without the consent of the client, Hong Kong Solicitors’ Guide to Professional Conduct 8.01. However, it is subject to a number of established and settled exceptions. For example, it does not extend to communications and documents made or brought into existence for the purpose of, or as part of the process of crime, fraud, abuse of statutory power or, in some circumstances, defeating or frustrating the administration of justice by the courts: Halsbury’s Laws of Hong Kong, Vol 17, Legal Practitioners [240.299], [240.067].
