释义 | 共同目的 An agreement or undertaking between a person and another or others that they will commit a crime. Where two or more persons embark upon a joint enterprise, that is, something which has a common purpose, each of them is liable for the acts done in that joint enterprise: HKSAR v Pun Ganga Chandra [2001] 2 HKC 192. Parties who act in pursuance of the common purpose may also be responsible for unforeseen consequences which could be reasonably inferred: Lau Sik Chun v R [1982] HKLR 113 (CA). A secondary party may be able to escape liability if he makes an effective withdrawal before the offence is actually committed: R v Grundy [1977] Crim LR 543 (CA); R v Whitefield [1984] Crim LR 294, 79 Cr App R 36 (CA); R v Szeto Kwok Hei [1991] 2 HKLR 178 (CA).
