释义 | 公用部分 In a multi-storeys building, common part includes the whole of a building, except such parts as have been specified or designated in an instrument registered in the Land Registry as being for the exclusive use, occupation or enjoyment of an owner: Building Management Ordinance (Cap 344) s 2. Common part must be maintained by the owner’s corporation of the building: s 18. Common area, whether allocated with or without undivided shares of the land, may be leased or reserved exclusively to the use of a particular person without loss of its status as common area: Jumbo King Ltd v Faithful Properties Ltd [1999] 2 HKC 507, 3 HKLRD 231. 就多層建築物而言,公用部分包括建築物的全部,但不包括在土地註冊處註冊的文書所指明或指定專供某一業主使用、佔用或享用的部分:《建築物管理條例》(第344章)第2條。建築物的業主立案法團必須保養公用部分:第18條。公用地方(不論是否配予土地的不分割份數)可專供某特定人士的用途而出租或預留,而不失去其作為公用部分的效力:Jumbo King Ltd v Faithful Properties Ltd [1999] 2 HKC 507, 3 HKLRD 231。 |
