| 释义 | 消費者保障 Legislative provision designed to protect participants in transactions where goods or services are acquired by them for personal, domestic or household use or consumption, but not for resale, use in trade or commerce, production, manufacturing or repair purpose. In Hong Kong, the Consumer Council was established and its functions are to protect and promote the interests of consumers of goods and services and purchasers, mortgagors and leasees of immovable property: Consumer Council Ordinance (Cap 216) s 4(1). A number of pieces of legislation are made for consumer protection: for example, Consumer Goods Safety Ordinance (Cap 456); Unconscionable Contracts Ordinance (Cap 458). When a person is ‘dealing as consumer’, he is protected from exemption clause under various pieces of legislation: Control of Exemption Clauses Ordinance (Cap 71); Sale of Goods Ordinance (Cap 26); Supply of Service (Implied Terms) Ordinance (Cap 457).
