释义 | 確證 A form of real evidence where, for example, an experiment is carried out to test the probity of oral evidence as to some matter, or to show that a certain event could have occurred in a certain way, or whether an event could have occurred at all. A demonstration may be conducted in or out of court. Demonstrations are admissible if they are relevant to a fact in issue. If a demonstration is performed in court, a written record should be made of it so that an appellate court may appreciate what was demonstrated: R v Chan Chun Ching [1989] 1 HKC 546. The court should also advise the parties of what it has noted of the demonstration so that if either party has a different perception of what occurred, they could ventillate their views: R v Yip Chung Kan (HCMA 477/93, unreported).
