The amount agreed contractually in advance by the parties payable as liquidated damages for delay beyond laytime: Food Corp of India v Mosvolds Rederi A/S (The Arras and The Hoegh River) [1986] 2 Lloyd’s Rep 597. The additional days required by the charterer for which the demurrage is paid are called days on demurrage. 2. Any damages for detention when laytime has expired. Damages for detention are unliquidated damages because no sum is agreed in advance. 3. Amount of commission paid to procure bail for the release of a ship which had been maliciously and without cause arrested: The Collingrove, The Numida (1885) 10 PD 158. When a ship has been arrested for an exorbitant sum, for which bail had been required, the court would award the defendants in the nature of demurrage the costs and expenses of finding it: The George Gordon (1884) 9 PD 46; The St Clair (Owners) v The Audny (Owners) 1922 SC 85. 4. In motor vehicle accidents or related cases, the liability of the defendant to compensate the plaintiff for any consequential loss, such as the cost of obtaining alternative transport (for example, cost of car hire) while the damaged car is being repaired or replaced: Moore v DER Ltd [1971] 3 All ER 517, 2 Lloyd’s Rep 359, 1 WLR 1476 (CA).
