In family law, the completion of a marriage by the first act of sexual intercourse after marriage which is ‘ordinary and complete’ not ‘partial and imperfect’: D v A (1845) 1 Rob Eccl 279. Therefore a transient penetration of the female organ by the male would not be sufficient: W (otherwise K) v W [1967] 3 All ER 178, 1 WLR 1554. A marriage which takes place after 30 June 1972 is voidable if the marriage has not been consummated owing to the incapacity of either party to consummate or the wilful refusal of one party to consummate: Matrimonial Causes Ordinance (Cap 179) s 20(2).
