释义 | 沒有作出警告 A breach of the duty, imposed on manufacturers and other product suppliers by the law of negligence, to warn of the risks that are not obvious or known to the end users. Generally, manufacturers owe to the ultimate consumers a duty of care that the products will not result in an injury to the consumer’s life and property: Donoghue v Stevenson [1932] AC 562, All ER Rep 1. An express warning of the danger will discharge the manufacturer’s duty: Kubach & Anor v Hollands & Anor (Fredrick Allen & Son (Poplar) Ltd, Third Party) [1937] 3 All ER 907. 違反藉疏忽法施加於製造商及其他產品供應商身上的責任,即沒有將不明顯或未知悉的危機向最後的使用者作出警告。概括而言,製造商對最終消費者負有謹慎責任,即是該等產品不會對消費者的生命及財產造成傷害:Donoghue v Stevenson [1932] AC 562, All ER Rep 1。明示的危險警告會解除製造商的責任:Kubach & Anor v Hollands & Anor (Fredrick Allen & Son (Poplar) Ltd, Third Party) [1937] 3 All ER 907。 |
