释义	衡平法留置權 An equitable right, conferred by law upon one person, to a charge upon the property of another, until certain specific claims have been satisfied. It arises by operation of law independent of possession and must on this characteristic be distinguished from a common law lien: Re Bond Worth Ltd [1979] 3 All ER 919, 3 WLR 629, [1980] Ch 228; Re Walsh Irish Ferries Ltd [1985] 3 WLR 610, [1986] Ch 471. It is subject to all the usual conditions affecting equitable rights. It may arise from contractual dealings in property, in the administration of trusts and out of general considerations of justice or upon the principle that he who seeks the aid of equity in enforcing some claim must admit the equitable rights of the others associated with the subject matter: Hewett v Court (1983) 149 CLR 639. A court of equity will analyse each relationship to decide whether a lien should be imposed to meet the needs of justice as between the parties: Hewett v Court, supra. It may attach to both real and personal property: Dansk Rekylriffel Syndikat Aktieselskad v Snell [1908] 2 Ch 127.
