Flying freehold |
A colourful expression for a freehold title to an upper floor of a building or to the airspace into which a building from adjoining land projects. Because as a practical matter such a freehold title relies on a right of support of the lower floors of that building, uncertainty exists as to the fate of the interest if the building is destroyed. Although it remains possible to subdivide airspace into strata at common law, techniques with more legal certainty have been preferred in Australia, namely, tenancies in common, company title and most recently strata title. See also Strata title; Tenancy in common. 另見 Strata title; Tenancy in common。 |
