| 释义 | 與敵貿易 An offence of carrying on trade with an enemy of the People’s Republic of China: Trading with the Enemy Ordinance (Cap 346) s 4(1). A person shall be deemed to have traded with the enemy if (a) he has had any commercial, financial or other intercourse or dealings with, or for the benefit of, an enemy, and if he has (i) supplied any goods to or for the benefit of an enemy, or obtained any goods from an enemy, or traded in, or carried, any goods consigned to or from an enemy or destined for or coming from enemy territory; or (ii) paid or transmitted any money, negotiable instrument, prescribed instrument or security for money to or for the benefit of an enemy or to a place in enemy territory; or (iii) performed any obligation to, or discharged any obligation of, an enemy; or (b) he has done anything which, under the provisions in the Trading with the Enemy Ordinance, is to be treated as trading with the enemy: s 4(2). See also Enemy. 凡與中華人民共和國的敵人進行貿易，即屬犯罪：《與敵貿易條例》（第346章）第4(1)條。任何人如有下述情況，須當作曾與敵貿易(a) 他曾與敵人有任何商業、財務或其他往來或交易，或為敵人的利益而有任何商業、財務或其他往來或交易，而他曾 (i) 提供任何貨品給敵人，或為敵人的利益而提供任何貨品，或從敵人處取得任何貨品，或買賣或運載任何托運給敵人或由敵人托運的貨品，或買賣或運載任何預定運往敵人領地或來自敵人領地的貨品；或(ii) 支付或轉傳任何款項、可流轉票據、《銀行業條例》（第155章）第137B條所指的訂明票據或就金錢而提供的保證給敵人，或為敵人的利益而支付或轉傳上述各項，或支付或轉傳上述各項至敵人領地內某處；或(iii) 向敵人履行任何義務，或將敵人的任何義務解除；或(b)他曾作出任何根據《與敵貿易條例》的條文而須視為與敵貿易的事情：第4(2)條。另見 Enemy。 |
