释义 | 樞密院頒令 A source of Hong Kong law before 1997. It is an order made by Her Majesty in Her Privy Council (being the Lords and others for the time being of Her Majesty’s Most Honourable Privy Council): Interpretation and General Clauses Ordinance (Cap 1) sch 9 para 1. Prior to the change of sovereignty in 1997, the Crown was empowered to extend the application of certain Acts of Parliament to Hong Kong by Orders in Council. At present, any reference to Her Majesty in Council or to the Privy Council, where the content of the provision relates to appellate jurisdiction in relation to Hong Kong, shall be construed as a reference to the Hong Kong Court of Final Appeal: Hong Kong Reunification Ordinance (Cap 2601) s 6. Orders in Council are no longer part of the law of Hong Kong: Re Yung Kwan Lee [1999] 1 HKC 801. 指在1997年香港法律的根源。在具有樞密院的意見的情況下,由英國皇室所作出的規則方式。在1997年主權更改前,樞密院頒令賦予皇室權力以延伸特定國會法案在香港的適用範圍。現時,對女皇陛下會同樞密院或對樞密院的提述,在條文的內容與關乎香港的上訴司法管轄權有關的情況下,須解釋為對香港終審法院的提述:《香港回歸條例》(第2601章)第6條。樞密院頒令不再是香港法律的一部分:Re Yung Kwan Lee [1999] 1 HKC 801。 |
