释义 | 指定人提單 A bill of lading, issued with the consignee ‘to order’, made out to the order of the shipper or indorsee (where the bill is transferred by indorsement). This prima facie deems the shipper to have reserved the right of disposal of the goods shipped under the bill of lading, which may rebut the presumption that the property in the goods passed on shipment in a FOB contract: The Teng He [2000] 4 HKC 701. The goods shipped under an order bill are deliverable only on the production of the original bill of lading: The ‘BRIJ’ [2000] 3 HKC 313. A bill made out to a named person (such as the consignee) or to his order is a hybrid of a straight bill and an order bill. Unless the carrier has knowledge that any other party is entitled to the possession of the goods, the delivery of the goods, shipped under such hybrid bill, to the named person, even without production of the original bill of lading, may not be regarded as misdelivery: The ‘BRIJ’, supra. An order bill is transferable by way of indorsement. A bill which is not capable of transfer is not regarded as a bill of lading for the purpose of the Bills of Lading and analogous Shipping Documents Ordinance (Cap 440) s 3.
