A plea which may be entered by an accused in answer to an indictment. An accused will stand trial upon a plea of not guilty. A plea of not guilty entitles the accused to be placed in charge of the jury: R v Heyes [1951] 1 KB 29, [1950] 2 All ER 587, 34 Cr App Rep 161 (CCA). The right to plead not guilty is guaranteed by the Bill of Rights: Hong Kong Bill of Rights Ordinance (Cap 383) s 8, art 11(2)(g). The accused by such a plea is deemed to have put himself upon his country for trial: Criminal Procedure Ordinance (Cap 221) s 50. The invariable practice where an accused is determined to be mute of malice or declines to plead, is that a plea of not guilty is entered on his behalf: s 51(1)(c). The same procedure of entering a plea of not guilty applies to a corporation which, on arraignment, does not enter a plea through its representative: s 49(3).
